An appeal has been denied in the case of an Indiana man who was convicted of sexually exploiting several juveniles, including one from Daviess County. 34-year-old Alex Payne of Tell City was sentenced in Daviess Circuit Court last year to 70 years in prison. Jurors found Payne guilty of six counts of use of a minor in a sexual performance, one count of use a minor in a sexual performance, and 12 counts of possession of material depicting a sexual performance by a minor. Payne appealed to the state Supreme Court, regarding the searches that yielded evidence in the case. One point that caused Payne to lose the appeal was that he voluntarily turned over his phone to police. Payne said the evidence on it should have been inadmissible.
